Cookies
Yes, you need a cookie policy if your website uses internet cookies to collect information from visitors. Laws such as the ePrivacy Directive and the General Data Protection Regulation (GDPR) require websites to detail their use of cookies to users. Internet cookies help websites function properly, but they also collect personal data from users and are heavily regulated by data privacy legislation. If your website uses internet cookies, you should post a cookie policy. Using one helps ensure you comply with applicable laws, and being honest with your users builds and maintains trust, leading to better customer retention.
Strictly necessary cookies are essential for a website to function properly. They enable basic features such as page navigation, secure login, and accessibility. Because of their importance, these cookies cannot be switched off in the cookie settings and usually do not require user consent.
The California Consumer Privacy Act (CCPA) does not explicitly require cookie consent, but it mandates that businesses provide consumers the right to opt-out of the "sale" of personal data, which may include data collected via cookies. A cookie banner can help you comply with CCPA requirements.
- First-party cookies are set directly by the website the user is visiting.
- Third-party cookies are set by other domains (e.g., advertisers or analytics providers) and are commonly used for tracking across different websites.
Under GDPR, Google Analytics cookies are considered non-essential and require user consent before being set. You should implement a cookie banner that blocks these cookies until the user has actively consented.
Non-compliance can result in legal actions, fines, and damage to your reputation. Authorities in the EU, such as CNIL (France) or the ICO (UK), have issued penalties to websites failing to implement proper consent mechanisms.
Consentise allows them to withdraw or change their consent via the cookie icon on your website.
Prior consent means that no non-essential cookies are set before the user has given explicit permission. This is a core requirement under GDPR and similar privacy regulations to ensure users have control over their personal data.
These cookies collect information about how users interact with a website, like pages visited or error messages received. The data helps improve website performance but typically requires user consent.
